By accessing or using the WelaSync platform, website, and services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Services. These terms apply to all visitors, users, and others who access or use the Services.

2. Definitions

• "WelaSync" refers to our company, platform, and services.
• "User" or "you" refers to any individual or entity using the Services.
• "Property" refers to a hotel, resort, hostel, or serviced apartment managed through the platform.
• "Guest Data" refers to personal information of guests collected and stored through the platform.
• "Subscription" refers to the paid plan chosen by the User.

3. Account Registration

To use the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access or breach
• Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these terms.

4. Subscription and Payments

WelaSync operates on a subscription model. By subscribing:

• You agree to pay all fees associated with your selected plan
• Subscription fees are billed in advance on a monthly basis
• Payments are processed through our secure third-party payment processors
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are provided at our discretion and in accordance with applicable law
• We may change pricing with 30 days' advance notice

5. Acceptable Use

You agree not to use the Services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the platform or other users' accounts
• Interfere with the proper functioning of the Services
• Collect or harvest personal information of guests without consent
• Use the platform for any illegal or fraudulent purpose

6. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. You are responsible for obtaining necessary consents from guests for collecting and processing their data. You retain ownership of your business data; we only use it to provide and improve the Services.

7. Intellectual Property

WelaSync and its licensors own all rights, title, and interest in the Services, including all software, designs, trademarks, and content. You are granted a limited, non-exclusive, non-transferable license to use the Services during your subscription. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

8. Third-Party Integrations

The Services may integrate with third-party platforms (e.g., Channex.io, LINE, Stripe). Your use of these integrations is subject to the third parties' terms of service. WelaSync is not responsible for the availability, performance, or actions of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, WelaSync shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless WelaSync, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these terms, or your infringement of any third-party rights.

11. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your access to the Services will cease, and we may delete your data after a reasonable retention period. Sections that by their nature should survive termination will remain in effect.

12. Governing Law

These terms are governed by the laws of Thailand. Any disputes arising from these terms shall be resolved in the courts of Bangkok, Thailand.

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the platform. Continued use of the Services after changes constitutes acceptance of the new terms.
